Trademark and Brand Usage Guidelines

These guidelines explain how a partner, affiliate, press outlet, customer or other third party may refer to and use the aicial name and brand assets.

1. About these guidelines

Aperim Pty Ltd (ABN 46150699737; ACN 150699737) is incorporated in New South Wales, Australia and operates the aicial brand. In this document, “aicial” refers to that brand; “we”, “us” and “our” refer to Aperim Pty Ltd; and “you” refers to a partner, affiliate, press outlet, customer or other person or organisation referring to or using the aicial name or brand assets.

aicial is not currently the subject of a registered trademark. These guidelines are not a claim of registered trademark rights, and nothing in them should be read as one. They set out aicial’s own guidance for how we expect our name and brand assets to be used, grounded in ordinary intellectual property, passing-off and consumer-protection principles rather than a registered mark. If that changes, we will update these guidelines, and our own use of trademark symbols, accordingly. Our Intellectual Property, Copyright and Trademark Notice sets out the underlying position on our brand and other intellectual property in more detail.

These guidelines explain how you may refer to and use the aicial name and the visual assets that make up our brand, including our wordmark and logo. They do not cover your own use of aicial’s services, if any, which remains separately governed by our Terms of Service.

If you have a separate written agreement with us that grants rights in our brand assets — for example our Reseller and Partner Program Agreement — that agreement governs your use to the extent of any inconsistency with these guidelines, and you do not need our separate permission under section 4 for a use it already covers.

2. The aicial wordmark

The aicial wordmark and logo — the specific graphic rendering of our name — are always lowercase: “aicial”, never “Aicial” or “AICIAL”. This is a rendering rule for the wordmark and logo assets themselves; if you reproduce them, please do not recapitalise them.

aicial is not the subject of a registered trademark, so the ® symbol — which signifies registration — is never used with our name or logo. We also choose not to use the ™ symbol, even though it does not require registration: our wordmark is rendered without any trademark symbol. Please do not add either symbol yourself.

Aperim Pty Ltd is the legal entity that operates the aicial brand. Refer to us as “aicial” in ordinary use; use “Aperim Pty Ltd” only where a legal or corporate reference is required, such as in a contract, an invoice or a company register entry.

3. Uses that do not require our permission

You do not need our permission to:

  • accurately refer to aicial by name in editorial, news or factual commentary;
  • factually state that you use aicial’s services — for example, “Powered by aicial” or “We use aicial for social analytics” — provided the statement is accurate and does not imply a partnership, endorsement or sponsorship that does not exist; or
  • refer to aicial by name for the purpose of comparison, criticism or commentary, provided the reference is accurate and not misleading.

These are the kinds of ordinary, accurate references to our brand that do not need our permission or a licence from us.

4. Uses that require our permission

Contact us before you:

  • use the aicial name or logo as part of a product name, domain name or company name;
  • use aicial’s logo or other visual brand assets in marketing material; or
  • describe or present your relationship with aicial in a way that implies an endorsement, partnership or certification that does not exist.

5. Prohibited uses

You must not use the aicial name or brand assets:

  • in a way that is false, misleading or defamatory; or
  • in connection with content of the kind prohibited by our Acceptable Use Policy.

We may ask you to stop a use that falls outside these guidelines. Where necessary, we may also take further steps available to us under intellectual property, passing-off or consumer-protection law to protect our brand and the people who rely on it.

6. Requesting permission

To request permission for a use described in section 4, or to check whether a use you are considering needs our permission, email legal@aicial.com with details of the intended use — where and how you plan to use the aicial name or brand assets, and for how long.

We aim to respond within a reasonable time. Permission we give is specific to the use described and may be subject to conditions, such as required attribution or use of a specific logo file; it does not extend to a different use or asset unless we say so.

7. Changes to these guidelines

We may update these guidelines from time to time as our brand and product evolve, including as we add new services or brand assets. The version, effective date and last-reviewed date shown at the top identify the current guidelines. We publish updates on our website.
